Legislation and standards this policy gives effect to

  • • Workers Compensation Act 1951 (ACT)
  • • Workers Compensation Act 1987 (NSW) and Workplace Injury Management and Workers Compensation Act 1998 (NSW)
  • • Workplace Injury Rehabilitation and Compensation Act 2013 (Vic)
  • • Workers' Compensation and Rehabilitation Act 2003 (Qld)
  • • Return to Work Act 2014 (SA)
  • • Equivalent legislation in WA, Tasmania and the NT

1. Insurance coverage

Axiom Data maintains a workers' compensation policy covering all of its employees and labour-hire workers in the Australian Capital Territory, where it is based, and obtains and maintains the required coverage in every other state or territory before a worker starts work there. Coverage is confirmed and recorded before each placement begins, and the policy certificate of currency is provided to a client on request. Independent contractors engaged through their own entity are required to hold their own cover and to provide evidence of it.

2. Scope and application

This policy applies to Ontology Analytics Pty Ltd, trading as Axiom Data (Axiom Data) and to every director, employee, labour-hire worker, contractor and agent engaged by Axiom Data, whether working at Axiom Data's premises, remotely, or on placement at a client site. Where a worker is placed with a client, this policy applies alongside the client's own policies; where the two differ, the worker follows the stricter requirement and raises the difference with Axiom Data.

3. When a worker is injured

  1. The worker obtains the treatment they need. In an emergency, call 000.
  2. The injury is reported to Axiom Data within 24 hours under the Incident Reporting Procedure (POL-05), and to the client where it occurred on placement.
  3. Axiom Data gives the worker the claim form and information about their rights, and notifies the insurer within the time the relevant law requires (in the ACT, within 48 hours of becoming aware of an injury).
  4. Axiom Data pays the worker's entitlements as the law and the insurer's determination require, and continues to employ the worker while they recover.
  5. The Director, or a nominated return-to-work coordinator, keeps in contact with the worker, the treating practitioner, the insurer and the client.

4. Injury management and return to work

  • A return-to-work plan is prepared with the worker and their treating practitioner for any injury expected to keep them off work or on restricted duties for more than a few days.
  • Suitable duties are offered where it is safe and reasonably practicable, in consultation with the client. Where the placement cannot accommodate restrictions, Axiom Data looks for alternative work.
  • The worker is not required to return before they are medically fit, and is not disadvantaged for making a claim.
  • Progress is reviewed at least fortnightly until the worker returns to pre-injury duties or the plan is closed.

5. Records and privacy

Claim records, medical certificates and return-to-work plans are kept confidential, stored securely, used only for injury management and insurance purposes, and retained for the period required by the relevant workers' compensation law.

6. Review

This policy is owned by the Director and is reviewed at least annually, and sooner if legislation, a client requirement or an incident shows the need. The current version, effective date and next review date are recorded in the policy register on the Employee Resources page.
